These Terms and Conditions (“Terms”) govern the use of the Promotika platform and services provided by Promotika (“we,” “us,” or “our”) by both Advertisers and Bajaji Owners. By accessing, registering, or using our services, you (“you,” “User,” “Advertiser,” or “Bajaji Owner”) agree to be legally bound by these Terms. These Terms are governed by the applicable laws of the United Republic of Tanzania.
Promotika is a platform that connects advertisers with Bajaji (three-wheeler) owners in Tanzania for mobile outdoor advertising. Advertisers promote their brands using physical advertisements placed on Bajajis, and Bajaji owners earn income by participating in these promotional campaigns.
To use our platform:
Advertisers must be 18 years or older and authorized to represent a business.
Bajaji owners must legally own or have permission to operate the Bajaji vehicle used for advertising.
All users must be based in or operating within the United Republic of Tanzania.
By using Promotika, advertisers agree to:
Provide accurate business and campaign information.
Approve the final artwork/designs prior to printing.
Accept that all payments made are non-refundable, regardless of campaign outcome or withdrawal.
Comply with applicable advertising standards, branding guidelines, and content restrictions in Tanzania.
Allow Promotika to manage driver matching, branding logistics, and performance tracking as per internal process.
By registering on Promotika, Bajaji owners agree to:
Allow Promotika to place physical advertisements (stickers, wraps, or approved materials) on their vehicles.
Keep the branded vehicle active and in clean, presentable condition during the campaign period.
Not tamper with, remove, or damage the ad materials before the agreed campaign end date.
Follow the agreed route or zone if required for specific campaigns.
Allow Promotika to use images, videos, and location updates of the Bajaji for marketing and performance reporting.
Understand that participation does not imply employment; drivers act as independent contractors.
Advertisers shall pay the agreed campaign fees upfront, in full.
Bajaji owners shall be compensated based on Promotika’s payout schedule, depending on the duration and route coverage of the campaign.
No refunds will be issued once payments are made by advertisers.
Bajaji owners forfeiting their participation mid-campaign may forfeit payment or face penalties.
Campaign durations are agreed in advance.
Promotika reserves the right to modify or end a campaign due to unforeseen circumstances, non-performance by the driver, or violations of terms.
Advertisers may not pause or cancel once a campaign is active.
Promotika reserves the right to reject any advertising content that:
Violates local laws, ethics, or advertising codes in Tanzania
Contains offensive, political, or culturally insensitive material
Misrepresents products or services
All designs, branding materials, and platform content remain the property of the respective advertiser or Promotika.
Bajaji owners may not copy, reproduce, or repurpose campaign visuals or materials for personal use or third-party gain.
We collect basic personal, contact, and location data to operate campaigns and track performance.
By using our platform, users consent to data collection and usage in accordance with Tanzania’s Data Protection regulations.
Promotika is not liable for:
Any damages to vehicles during the campaign caused by natural wear or external accidents.
Any legal disputes between drivers and third parties.
Loss of expected results or customer turnout for advertisers.
We reserve the right to terminate or suspend any account or campaign for:
Violation of these terms
Fraudulent or misleading information
Interference with campaign operations
These Terms shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania. Any disputes arising out of these Terms shall be settled under Tanzanian legal jurisdiction.
